SMS Program Terms & Conditions

Inter Miami CF, LLC (“IMCF” or “we”) provides short message service (“SMS”) updates, mobile alerts, and mobile call to action campaigns (collectively, the “IMCF SMS Program”). Please read these SMS Terms and Conditions (“Terms”). If you (“you”) do not agree with these Terms, please do not participate in or use the IMCF SMS Program. These Terms incorporate by reference an Arbitration Agreement, Class Action Waiver, and Jury Trial Waiver that affects your legal rights. Message and data rates may apply.

CONSENT TO RECEIVE A TEXT MESSAGE IS NOT A CONDITION OF PURCHASING A GOOD OR SERVICE.

I. Terms

By entering an IMCF SMS Program or promotion, you agree to be bound by these Terms and Conditions, as well as MLS’s Terms of Service accessible at https://www.mlssoccer.com/legal/terms-of-service (including the arbitration provision set

forth therein) and the MLS Privacy Policy accessible at https://www.mlssoccer.com/legal/privacy-policy (both of which are incorporated herein by reference). Data obtained from in connection with this service may include Personal Information. Please see MLS Privacy Policy regarding what information may be collected and how such information may be used by us. MLS reserves the right to modify these the MLS Terms of Service and the MLS Privacy Policy at any time if necessary, and IMCF reserves the right to modify these Terms.

You agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. You confirm that you are the subscriber to the relevant phone number or that you are authorized to opt-in to messages. If IMCF, in its sole discretion, believes that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the IMCF SMS program and pursue any appropriate legal remedies. We are not liable for your use of or reliance on any text message content.

II. SMS Services

(a) Opt-in Information

By texting the provided message as promoted in the applicable promotion to the designed short code, or by opting-in to the IMCF SMS Program through the sign-up page on the IMCF website, you agree that you are providing express written consent to Inter Miami CF, LLC to receive text messages via automatic telephone dialing system and are opting in to join the

IMCF SMS Program. After opting in, in addition to the main messages the IMCF SMS Programoffers, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your opt-in. You will receive SMS messages on behalf of IMCF regarding games, tickets, as well as occasional promotions, until you opt-out using the opt-out method provided herein. The number of messages that you receive through the service will vary depending on the number of promotions, games, and other events taking place each month. IMCF may terminate the IMCF SMS Program at any time and for any reason.

IMCF text alerts are open to all persons 13 and older located in the Continental United States (including Washington, DC), Hawaii, Alaska, US Virgin Islands and Puerto Rico and is void where prohibited by applicable law, rule or regulation. By opting in to IMCF alerts, fans agree to be bound by these Terms (in addition to the MLS Terms of Service and MLS Privacy Policy) and that the decisions of IMCF, MLS, and each of their representatives are final and binding in all respects.

Message and data rates may apply when participating. Depending on your wireless plan, your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider regarding their pricing plans as other charges may also apply. Message and data charges may appear on your cell phone bill or be deducted from your prepaid account. You are responsible for any fees assed by your wireless telephone carrier to IMCF, including any data plan charges, text messaging charges, tolls, out-of-area roaming, or other telephone connection charges. We may use an automatic dialing system to send you text alerts. Text messages may not be available from all carriers. You are responsible for letting IMCF know if your phone number changes.

(b) STOP and Opt-Out Information

You agree and understand that the only way to stop receiving text messages is to text STOP to the number from which you received the text message. If in the future you decide to join the IMCF texting program again, please follow the opt-in process.

III. Requirements/Instructions

Subscribers must:

• Use a wireless device capable of two-way messaging

SMS service is offered on an “as is” basis and may not be available in all areas at all times. We do not guarantee that you will successfully receive text messages. IMCF SMS Program may not continue to work in the event of a product, software, coverage or other service changes made by your wireless carrier.

Inter Miami CF, LLC, Major League Soccer, L.L.C., Soccer United Marketing, LLC, and each of their respective parents, subsidiaries and affiliated entities and any persons employed by any of the foregoing, are not responsible and shall not be liable for any losses/injuries or any kind resulting from any delays in the receipt of any SMS message, lost, incomplete, late, undelivered, damaged or misdirected messages; inability to access the voting; difficulties, failures or malfunctions of computers and/or Internet connections or wireless services or other communications malfunctions; interrupted or unavailable network, server; failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion or for any technical problem which may cause the voting to be disrupted or corrupted; computer on-line systems, telecast, or cable malfunctions; human error; any damage to entrants or any third person’s computer and/or wireless device, and/or its contents related to or resulting from IMCF SMS program; nor any other loss directly or indirectly caused by participation in IMCF SMS program. Any attempt to deliberately damage, destroy, tamper or vandalize the website of IMCF or MLS is a violation of criminal and civil laws.
